12-unit townhouse fails; OLT referral expected A rezoning application to permit a 12-unit stacked townhouse condominium at 271 Main Street East, Dundalk (applicants Kale and Ridge Barnes) failed on a 3–3 recorded vote — Councillors Rice and Ferguson and Deputy Mayor Dobrin opposed; the motion was lost. Staff advised council immediately afterward that under provincial regulation it must pass a written explanation for the refusal, noting the matter will almost certainly proceed to the Ontario Land Tribunal. Council recorded the three dissenting reasons: too many units for the lot size, traffic and pedestrian safety concerns, and worries over snow storage and parking overflow into adjacent commercial properties. A separate amendment directing staff to advise Grey County to hold an additional public planning meeting on the associated condominium application carried unanimously. A motion to require a developer-funded crosswalk on Main Street died for want of a seconder.

Flato/Flat Out subdivision securities drawn — In the meeting’s most contentious item, council voted 6–0 to draw approximately $3 million in securities from Flat Out Developments (also referred to as Flato) under Finance report 2026-033, citing default on subdivision agreements across phases dating to roughly 2018. Triton Engineering will administer RFPs and supervise completion of outstanding work — incomplete sidewalks, boulevard grading, and backyard drainage — with staff warning that concrete installation season ends around mid-October. Developer representative Mr. Evruta addressed council and attributed delays to real estate market conditions; Paul Arruda of Flato also appeared during open forum to request a two-week extension on a related council resolution to allow the company to finalize a work plan.

Staff have not yet issued a recommendation; the County must rule first. At Councillor Martin’s request, the comments will include a retail impact study requirement, framed neutrally as an assessment of effects on downtown revitalization — after Martin flagged that the large commercial component could support a Walmart-scale retailer. Staff will also require the proponent to submit a concept site plan addressing parking, access, and housing form before the process advances. The Ministry of Transportation has identified dual turn lanes at Highway 10 as an eventual requirement, but traffic studies place that threshold at approximately 2032. The southern portion of the lands remains under a Ministerial Zoning Order; the proponent’s most recent submission was deemed incomplete by the Ministry, with no new response received.
